Eligibility for Nonimmigrant Visa for a Spouse (K-3) in Thailand:
There are three fundamental prerequisites for obtaining a K-3 visa as follows:
⦁ Your spouse in the United States must be legally wed to you.
⦁ In Thailand or any other specified country or jurisdiction, the marriage must be legal and meet all requirements.
⦁ Spouses who are citizens of the United States must meet financial requirements and provide recent tax returns that indicate gross income at least 100% of the minimum income.
⦁ You must have your U.S. spouse submit a Form I-130 (Petition for Alien Relative) on your behalf.
⦁ Your intention to reside in the United States as stated on your Form I-130 for USCIS consideration.
With a K3 visa, can a spouse bring their child/children to America?
The K-4 visa is for child/children of spouses who are foreign citizens. Your child/children will be able to reside in the United States because of the K-4 visa. T

The process for submitting a K-3 visa application
The process of applying for a K-3 visa in Thailand consists of two simple processes as follows:
Process 1: Filing in the United States
For US K-3 visas for Thai nationals, US spouses must file Form I-129F with USCIS. Form I-129F is "Petition for Alien Fiancée."
Required documents:
• Passport or proof of citizenship of the US citizen spouse.
• Passport of the foreign spouse
• Marriage certificate (both)
• Proof of previous marriage's divorce.
• Confirmation letter for Form I-130 (Petition for Alien Relative).
• Form I-94 (proof of arrival/departure from the US, if applicable)
• Passport photograph of the US citizen spouse.
• Passport photograph of the foreign spouse.
There is no fee for filing an I-129F, which is one benefit of the K-3 visa. Within 30 days of the application date, a notice of receipt is typically provided to the applicant.
